Traveling in Spanglish, LLC


1. Overview

These Terms & Conditions (“Agreement”) govern all tours, online events, digital products, cultural experiences, and other services offered by Traveling in Spanglish, LLC (“Company,” “we,” “our”).

By reserving a tour, registering for Luz Sessions, purchasing a digital product, or participating in any experience offered by Traveling in Spanglish, LLC, you agree to this Agreement in full.


2. Luz Sessions

The following terms apply to all registrations for Luz Sessions, Traveling in Spanglish’s online cultural discussion series.

Registration

Registration is confirmed upon receipt of payment. Each registration is valid for one participant and may not be transferred without prior written approval from Traveling in Spanglish, LLC.

Cancellations, Refunds & Credits

Participants may cancel for a full refund at any time before the monthly curated guide has been delivered.

Once the curated guide has been delivered, registrations become non-refundable, as a portion of the purchased experience has already been provided.

If you notify Traveling in Spanglish before the scheduled session begins that you are unable to attend, your registration may be applied as a credit toward a future Luz Session.

Curated Guide & Intellectual Property

Each monthly curated guide is created exclusively for registered participants and is intended for personal use only. The guide and its contents may not be copied, reproduced, distributed, shared, published, or used for commercial purposes without prior written permission from Traveling in Spanglish, LLC.

Traveling in Spanglish reserves the right to refuse future participation to individuals who violate these terms.

Technology Requirements

Participants are responsible for providing a reliable internet connection, a compatible device, and access to Zoom in order to participate in each session.

Recording

Traveling in Spanglish may record brief portions of a Luz Session for promotional or educational purposes. Participants will always be notified before recording begins. The primary discussion portion of each session will not be recorded.

Late Arrival Policy

Sessions begin promptly at the scheduled start time. Participants may join up to 15 minutes after the scheduled start time. After the first 15 minutes, the Zoom meeting will be locked to preserve the flow of the discussion, and late entry will not be permitted. Registrations are non-refundable if participation is missed due to late arrival.

Respectful Participation

Luz Sessions is a community built on curiosity, kindness, and respectful dialogue. Participants come from diverse backgrounds and may hold different personal, cultural, religious, or political beliefs. Thoughtful discussion and differing perspectives are welcome; disrespectful, discriminatory, or disruptive behavior is not.

By participating, you agree to contribute to a welcoming environment where ideas may be explored with openness and respect. Traveling in Spanglish, LLC reserves the right to remove any participant whose conduct interferes with the experience of others or is inconsistent with the values of the community. Refunds will not be issued in these circumstances.


3. Tours- What’s Included & Not Included

Included

  • Lodging (as specified in your tour itinerary)
  • Ground transportation during the tour
  • Cultural activities and experiences
  • Services of trip leaders, guides, and coordinators
  • Select meals (only when specifically listed)

Not Included

Flights are NOT included in your tour package.
Participants are fully responsible for:

  • Airfare
  • Airline baggage fees
  • Passport/visa expenses
  • Travel insurance
  • Some meals (unless noted)
  • Personal purchases & souvenirs
  • Medical expenses
  • Upgrades or optional activities
  • Any costs arising from flight delays or cancellations

4. Tour Payments

You may pay using one of the following options:

Option 1 — Pay in full at booking
Option 2 — Payment Plan

  • 60% non-refundable deposit at booking
  • 40% non-refundable final payment due 60 days before tour departure

Failure to make payments on time constitutes a default.

All payments are non-refundable except as explicitly stated in this Agreement.


5. Tour Cancellations & Refunds

Participant Cancellations

  • More than 60 days before departure: refund minus deposit
  • Within 60 days of departure: no refund
  • No refunds for late arrival, early departure, or missed activities

Company Cancellations

If the Company cancels a tour, you may choose:

  1. Transfer to a future tour, or
  2. Refund of all payments excluding any independently booked flights or personal travel expenses

Third-Party Disruptions

The Company is not liable for any changes, cancellations, or delays caused by third-party vendors such as:

  • Airlines
  • Hotels
  • Transportation operators
  • Museums and cultural sites
  • Accommodations
  • Guides
  • Activity hosts

Traveling in Spanglish, LLC acts solely as a tour organizer and facilitator. We do not own, operate, or control third-party service providers including but not limited to accommodations, transportation providers, guides, restaurants, or activity hosts. All such services are provided by independent contractors, and participants agree that Traveling in Spanglish Tours, LLC is not liable for the acts, errors, omissions, or negligence of these third parties.

We reserve the right to modify the itinerary at any time for safety or logistical reasons.

While every effort is made to deliver the itinerary and experiences as described, Traveling in Spanglish Tours, LLC does not guarantee specific outcomes, experiences, or conditions, or satisfaction. Travel inherently involves variability, and participants understand and acknowledge that differences in personal expectations, preferences, and unforeseen circumstances do not constitute grounds for refund or liability.

Traveling in Spanglish, LLC will always make reasonable, good-faith efforts to deliver a high-quality experience and to adapt to any changes in a way that preserves the overall integrity of the tour.


6. Tour Code of Conduct

Participants must:

  • Be respectful to fellow travelers, staff, and local communities
  • Follow local laws and cultural customs
  • Avoid illegal, dangerous, or disruptive behavior

The Company may remove any Participant for behavior that jeopardizes safety or experience quality.
No refunds are given for removal.


7. Tour Assumption of Risk & Liability Waiver

International travel involves inherent risks, including but not limited to:

  • Illness or injury
  • Foodborne or communicable diseases
  • Weather hazards
  • Uneven terrain
  • Crime or theft
  • Delays or disruptions

By participating, you agree to assume all risks and release the Company, its owners, employees, and partners from:

  • Liability for injury, illness, or death
  • Loss or damage to property
  • Financial loss caused by delays or vendor failures

The Company is not responsible for lost or stolen possessions at any time.

Participants are responsible for their own physical condition, travel readiness, and personal decisions during the tour. Participation in all activities is voluntary, and individuals assume full responsibility for their participation.

Participants acknowledge that travel experiences are inherently subjective and may vary based on personal preferences, expectations, and unforeseen circumstances. By participating in the tour, individuals accept that not all aspects of the experience can be guaranteed and agree that such variability does not constitute grounds for complaint, refund, or liability.


8. Tour Health & Fitness Requirements

You affirm that you are physically capable of participating in activities including walking tours, hills, steps, and outdoor environments.

You must disclose:

  • Medical conditions
  • Mobility issues
  • Allergies
  • Dietary needs

You are responsible for all medical costs incurred during the tour and for obtaining travel medical insurance.


9. Defaults & Remedies

You are in default if you:

  1. Fail to pay invoices when due
  2. Violate any term of this Agreement
  3. Engage in prohibited or unsafe conduct

Company remedies include:

  • Removal from the tour (at your expense)
  • Retaining all monies paid
  • Seeking recovery of damages and attorney’s fees

10. Governing Law, Arbitration & Venue

This Agreement is governed by the laws of the State of Florida.

The Company may choose either:

  • Arbitration, or
  • Litigation

You waive the right to a jury trial.

Venue for all disputes is Pinellas County, Florida.


11. Force Majeure

The Company is not responsible for delays, cancellations, or the inability to perform due to events outside its control, including:

  • Natural disasters
  • Pandemics
  • Government restrictions
  • War or civil unrest
  • Strikes or labor disputes
  • Severe weather
  • Airline cancellations
  • Local closures

Refunds are not guaranteed in force majeure situations, though the Company will attempt to recover and return any refundable funds.


12. Florida Seller of Travel Disclosure

Traveling in Spanglish Tours, LLC is registered with the Florida Department of Agriculture & Consumer Services as a Florida Seller of Travel.

Registration Number: ST46159

Registration does not imply approval, recommendation, or endorsement by the State of Florida.


13. Travel Insurance Recommendation

Travel insurance is strongly recommended, including coverage for:

  • Trip cancellation
  • Medical emergencies
  • Lost or delayed luggage
  • Travel delays

You are responsible for reviewing the policy details of any insurance purchased.


14. Media Release

Traveling in Spanglish, LLC may photograph or record limited portions of tours, Luz Sessions, or other experiences for promotional, educational, or marketing purposes, including use on our website, social media platforms, newsletters, and other marketing materials.

Participants will be notified before any recording takes place. The primary discussion portion of Luz Sessions will not be recorded.

If you prefer not to appear in photographs or recordings, please notify Traveling in Spanglish, LLC in writing before the experience begins. We will make reasonable efforts to honor your request; however, we cannot guarantee that you will not appear incidentally in group photographs or recordings.


15. Acceptance

By reserving a tour, registering for Luz Sessions, purchasing a digital product, or participating in any experience offered by Traveling in Spanglish, LLC, you acknowledge that you have read, understood, and agree to these Terms & Conditions
