Traveling in Spanglish Tours, LLC


1. Overview

These Terms & Conditions (“Agreement”) govern all tours, services, and travel arrangements offered by Traveling in Spanglish Tours, LLC (“Company,” “we,” “our”). By reserving or participating in any tour, the Participant (“you”) agrees to this Agreement in full.

Traveling in Spanglish Tours provides curated cultural travel experiences in partnership with independent third-party travel vendors such as hotels, guides, drivers, and restaurants.


2. What’s Included & Not Included

Included

  • Lodging (as specified in your tour itinerary)
  • Ground transportation during the tour
  • Cultural activities and experiences
  • Services of trip leaders, guides, and coordinators
  • Select meals (only when specifically listed)

Not Included

Flights are NOT included in your tour package.
Participants are fully responsible for:

  • Airfare
  • Airline baggage fees
  • Passport/visa expenses
  • Travel insurance
  • Some meals (unless noted)
  • Personal purchases & souvenirs
  • Medical expenses
  • Upgrades or optional activities
  • Any costs arising from flight delays or cancellations

3. Payments

You may pay using one of the following options:

Option 1 — Pay in full at booking
Option 2 — Payment Plan

  • 60% non-refundable deposit at booking
  • 40% non-refundable final payment due 60 days before tour departure

Failure to make payments on time constitutes a default.

All payments are non-refundable except as explicitly stated in this Agreement.


4. Cancellations & Refunds

Participant Cancellations

  • More than 60 days before departure: refund minus deposit
  • Within 60 days of departure: no refund
  • No refunds for late arrival, early departure, or missed activities

Company Cancellations

If the Company cancels a tour, you may choose:

  1. Transfer to a future tour, or
  2. Refund of all payments excluding any independently booked flights or personal travel expenses

Third-Party Disruptions

The Company is not liable for any changes, cancellations, or delays caused by third-party vendors such as:

  • Airlines
  • Hotels
  • Transportation operators
  • Museums and cultural sites

We reserve the right to modify the itinerary at any time for safety or logistical reasons.


5. Code of Conduct

Participants must:

  • Be respectful to fellow travelers, staff, and local communities
  • Follow local laws and cultural customs
  • Avoid illegal, dangerous, or disruptive behavior

The Company may remove any Participant for behavior that jeopardizes safety or experience quality.
No refunds are given for removal.


6. Assumption of Risk & Liability Waiver

International travel involves inherent risks, including but not limited to:

  • Illness or injury
  • Foodborne or communicable diseases
  • Weather hazards
  • Uneven terrain
  • Crime or theft
  • Delays or disruptions

By participating, you agree to assume all risks and release the Company, its owners, employees, and partners from:

  • Liability for injury, illness, or death
  • Loss or damage to property
  • Financial loss caused by delays or vendor failures

The Company is not responsible for lost or stolen possessions at any time.


7. Health & Fitness Requirements

You affirm that you are physically capable of participating in activities including walking tours, hills, steps, and outdoor environments.

You must disclose:

  • Medical conditions
  • Mobility issues
  • Allergies
  • Dietary needs

You are responsible for all medical costs incurred during the tour and for obtaining travel medical insurance.


8. Defaults & Remedies

You are in default if you:

  1. Fail to pay invoices when due
  2. Violate any term of this Agreement
  3. Engage in prohibited or unsafe conduct

Company remedies include:

  • Removal from the tour (at your expense)
  • Retaining all monies paid
  • Seeking recovery of damages and attorney’s fees

9. Governing Law, Arbitration & Venue

This Agreement is governed by the laws of the State of Florida.

The Company may choose either:

  • Arbitration, or
  • Litigation

You waive the right to a jury trial.

Venue for all disputes is Pinellas County, Florida.


10. Force Majeure

The Company is not responsible for delays, cancellations, or the inability to perform due to events outside its control, including:

  • Natural disasters
  • Pandemics
  • Government restrictions
  • War or civil unrest
  • Strikes or labor disputes
  • Severe weather
  • Airline cancellations
  • Local closures

Refunds are not guaranteed in force majeure situations, though the Company will attempt to recover and return any refundable funds.


11. Florida Seller of Travel Disclosure

Traveling in Spanglish Tours, LLC is registered with the Florida Department of Agriculture & Consumer Services as a Florida Seller of Travel.

Registration Number: [Insert once issued]

Registration does not imply approval, recommendation, or endorsement by the State of Florida.


12. Travel Insurance Recommendation

Travel insurance is strongly recommended, including coverage for:

  • Trip cancellation
  • Medical emergencies
  • Lost or delayed luggage
  • Travel delays

You are responsible for reviewing the policy details of any insurance purchased.


13. Media Release

Unless you opt out in writing before departure, you grant permission for the Company to use photos or videos taken during the tour for marketing and promotional purposes.


14. Acceptance

By reserving a tour with Traveling in Spanglish Tours, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
